08/30/08 The Overnight Greenwich News Roundup For Saturday Morning (Updated)

As he waited for the start gun, Greenwich resident Tom O'Connell made a half-serious vow to never lose again to his sailing buddy, Benoit Ansart, who last year finished ahead of him in the annual Vineyard sailing race, sponsored by apparel company Vineyard Vines.

"I finished second" of two, O'Connell joked. "Not this time."

The two men were among the more than 500 skippers and crew members who turned out Friday for the 74th annual Vineyard Race. The competition, which launches from the Stamford Yacht Club, is the final contest of three in the Northern Ocean Racing Trophy.

The course spans 238 miles and typically takes about 35 hours, bringing racers east out of Long Island Sound, past Block Island, R.I., to the light tower at Buzzard's Bay off Martha's Vineyard and back....

A federal appeals court on Friday refused to reinstate charges against a businessman accused of offering hundreds of millions of dollars to top officials in Azerbaijan in exchange for favorable treatment in oil deals.
In its ruling, the 2nd U.S. Circuit Court of Appeals in Manhattan agreed with a lower court that the deadline to reinstate most of the dismissed charges against Frederic Bourke Jr., of Greenwich, had passed.

The ruling did not immediately affect related charges pending against investment promoter Viktor Kozeny, an Irish citizen of Czech background who is in the Bahamas appealing an order of deportation. Kozeny cannot fight the U.S. charges unless he returns to American soil.

Earlier this year, the government dropped charges against a third man, David Pinkerton of Bernardsville, N.J.

Bourke and Pinkerton, who are U.S. citizens, were charged along with Kozeny in 2005 with conspiring to violate the Foreign Corrupt Practices Act and the Travel Act.

Prosecutors alleged that the trio schemed to pay tens of millions of dollars to buy off senior officials from the former Soviet republic of Azerbaijan from 1997 to 1999.

The Foreign Corrupt Practices Act makes it a crime to offer payment to foreign government officials to obtain or retain business. Besides cash, the defendants also provided jewelry and luxury items and free medical treatment to the officials, prosecutors said.

To the editor:
I would like to clarify Neil Vigdor's account of the issues surrounding the potential removal of trees in Bruce Park.
As I explained to Mr. Vigdor when he called to inform me that trees were being posted with notices by the office of Bruce Spaman, the town's tree warden, we first discovered that several old specimens were diseased and declared to be at high risk last September when, in the course of researching the museum's renovation and expansion plans, our architects undertook an independent study of the health of the trees with the help of professional arborists from Bartlett Tree Research Laboratories.

Once we had this information, we were legally obliged to share it with the town, whose responsibility it is to monitor and maintain the trees in public spaces. The information was submitted to Mr. Spaman and reviewed with him on the museum's property last November.

By posting notices on the trees this week, it is assumed that Mr. Spaman concurred with the report and its recommendations. It therefore is incorrect to suggest that the museum requested or made an application for the trees' removal.

I might add that in our planning, we have taken the stewardship of the park very seriously and seek to save as many old, healthy trees as possible, proposing to replace diseased specimens with new plantings.
Our plans also call for environmentally responsible, "sustainable" building materials and practices. One need only visit the museum at the moment, when we have three interrelated shows on climate change, to appreciate the Bruce's ongoing commitment to nature and the environment.
