Police Critic Once Again Threatened With Arrest As Greenwich Police Department Once Again Attempt Illegal Search Of His Wives Store.


A Greenwich Police Detective who refused to give his name came to my wives store with two Connecticut Sign Inspectors.


I told the Greenwich Police Detective that because I and others in Greenwich had a police misconduct complaints that were not investigated I am not going to let any Greenwich Police Officer in my wives store without a warrant.


Upon hearing this the Greenwich Police Detective said that if I did not open the door my wife and I would be arrested.


Once again, I told the Greenwich Police Detective, who would not give out his name, that I wanted him to leave if he did not have a court order that said I had to let him into my wives store.


I even explained to the two Connecticut Sign Inspectors that I probably would have let them into my wives store if they had came alone or if they were in charge and conducting the investigation instead of the Greenwich Police Detective that refused to give his name.


I told the Connecticut sign inspectors that the police department had been contacting my employer, my landlord, was trying to order a property tax audit of the store and had been trying to prevent me from taking the Greenwich Legislative Seat I had been elected to last November, because I had criticized them in a blog and filed a police misconduct complaint against them.


I further explained to the Connecticut Sign Inspectors, that the Greenwich Police Department withdrew a ticket about my sign when I called 911 for a police supervisor about my wives store beaning illegally searched by four police officers.


I then told the Connecticut Sign Inspectors that I would appreciate it if they could get a warrant for the search and to please make an appointment so that I could have a lawyer present. This way there would be no problems with the Greenwich Police Department.


I then politely asked the Connecticut Sign Inspectors to leave my wives store front.


This caused the Greenwich Police Detective, with no name, to once again demand that I open my wives store door or I would be arrested.


I told the Greenwich Police Detective with no name that he could kick down the glass door and arrest me, but I was calling 911 to call the police.


I called 911 and explained the problem and that I wanted the gentlemen to leave, but they would not leave. I then gave the 911 operator the license plates of the two cars that the no name Greenwich Police Detective and they came in.


The Two Connecticut Sign Inspectors and the Greenwich Police Detective with no name started to go to their cars as I was calling 911 and then started to pull away.


But the the cars parked again and the Greenwich Detective got out and once again demanded that I let him in the store or that I will be arrested. Once again I called 911 for help.


I went to the back of the store.


I was told to call the non emergency number and I did.


I repeated to the operator that I wanted them to get a warrant and that I wanted them to leave.


She told me that a police officer and a Greenwich Police Lt. Heavey.


A Police Officer came and started violently banging on the store door, demanding that I open the door. Once again I called 911 to complain the 911 operator with the Greenwich Police Officer banging on the door in the background.


The 911 operator told me the officer wanted me to open the door so that he could ask me whats wrong.


I told her I wanted the Connecticut Sign Inspectors and the Greenwich Detective that has no name to get a warrant and to let me get a lawyer if possible.


I repeatedly told the 911 operator that I wanted the Greenwich Police to leave my wives store. The Greenwich Police and the Connecticut Sign Investigators eventually left the store.


I then called the Governor's Office to complain about the Connecticut Sign Inspectors who would not leave the store. I told him all of the above. He took my information and recommended that I call the commission that the Connecticut Sign Inspectors work for.


I called the commission and spoke with an officer McQuade who took down all the information and said she would report everything to her boss a Mr. Zenga. She wanted to know the names of the two inspectors and I told her I would call the Greenwich Police Department and get their names.


I then asked to leave a message in Mr. Zenga's voicemail. I explained everything and left my number.


I then called the Greenwich Police Department and asked the names of the two Connecticut Sign Inspectors were. I was told to wait in front of my wives store and someone would come see me.


I waited for almost two hours and had to call the Police Department a couple of times, but I eventually got Lt. Heavey. I told Lt. Heavey all that had happened and asked for the names of the two Connecticut Sign Inspectors that would not leave my wives store.


I told Lt. Heavey I wanted to file misconduct complaints against all those involved, because it should not take three 911 calls and 1 police non-emergency call to get the to leave after I told them that I did not consent to a search of my wives store.


Lt. Heavey said that he or the other officer that had came down to eventually chase them away did not know the names of the Greenwich Detective or the Connecticut Sign Inspectors. However, Lt. Heavey assured me that If he found out their names he would come by and tell me.


Tomorrow, I will have to file three misconduct complaints for Greenwich Detective John Doe 1, Connecticut Inspector John Doe 2 and Connecticut Inspector John Doe 3.


I am also filling a Freedom Information Request for the 911 tapes, The Police Radio Tapes and the non-emergency Phone call tapes.


Unfortunately, It appears that I am going to have to file a lawsuit against the Town Of Greenwich, The Greenwich Police Department and other agencies involved in their retaliatory pattern of civil rights violations.


Tomorrow, I am also going to file a Freedom Of Information Request for all of the persons who have filed a police misconduct complaint against the Greenwich Police Department. Each case will have the details posted at Greenwich Roundup and I will try and contact misconduct victims about a class action lawsuit, because of the Greenwich Police Departments pattern of ignoring and not investigating misconduct claims.

A Lady Lawyer Who Has Been A Customer In The Past Came Into My Wives Store And Told Her Not To Worry And Hoped That She Was Feeling Better.


The Attorney Then Told My Wife That If The Town Were To Evict Us From Our Home Connecticut State Law Says That The Town Has To Find Us Other Housing In Town. She Also Said The Town Would Also Be Responsible For Protecting Storing And Moving Our Possesions.


Further, she said that if the Town were to evict us, the building department would have to go after our landlord and not us.


However, she said if the landlord was to evict us a Judge could just throw us and our possessions on to the street.


She gave us her card and said to call her if the building department evicted us, she said she would see too it that the Town had to find us housing.


She then said she thought it was just awful how the Greenwich Police Department had reacted to my blog criticisms of their performance.
Maybe, it's a good thing that a weak and ineffectual Police Commissioner is allowing the Greenwich Police Department to spin out of control with thier retalitory vendetta against me.

01/07/08 - The Police Department Wont Stop It's Unethical And Illegal Retailitory Practices - It's Time To Contact Victims For A Class Action Lawsuit


Not Too Many Greenwich Citizens Are Aware That About 100 Days Ago A Cos Cob Man Sued The Town Of Greenwich And It's Police Department For Four Million Dollars.


A Cos Cob man recently filed a civil rights suit in Federal Court against the Town , The Former Police Chief and four police officers stemming from an assault and a wrongful arrest.


The suit filed in U.S. District Court in Bridgeport, states that policemen wrongfully arrested Frank A. Bertino after an officers unprovoked attack on Bertino at 322 Palmer Hill Road. The lawsuit seeks 4 Million Dollars in compensatory and punitive damages.


The Town Of Greenwich has filed a response.


According to the lawsuit, Bertino was outside of the home when trying to ask police about the arrest when Lt. James Heavey asked him to wait to be spoken to. As Mr. Bertino moved back another officer grabbed his wrist and attacked him, Screaming that Bertino was resisting arrest.


The officer then threw Mr. Bertino into a bush and then into a wall as other officers started to join in and handcuff Bertino, severely twisting his wrist arm and shoulder in the process.


The police then charged Mr. Berino with breach of peace and interfering with a police officer.


Mr. Bertino has suffered permanent and sever injuries from the incident.


Mr. Bertino's attorney Kevin Coles stated in the lawsuit that Officers Daniel Hendrie, John King and Eric Scorca, as well as, Lt. Heavey failed and refused to properly investigate the situation before arresting Mr. Bertino.


Moreover, attorney Kevin Coles says that Greenwich Police Officers lacked probable cause to make the arrest.


Now here is where it gets interesting.


The lawsuit also states that the Town Of Greenwich and the Greenwich Police Department failed to investigate a misconduct complaint Mr. Bertino filed against the officers.


Once again the Town Of Greenwich and it's Police Department is failing to provide constitutionally protected due process rights to it's citizens that make misconduct complaints about the police department.


Doesn't this sound familiar?


With in two business days of my police misconduct complaint, the illegally appointed Greenwich Police Captain Michael Pacewicz, ruled the complaint unfounded and refused to interview witnesses and myself and my wife.

Of coarse Town Attorney John Wayne Fox just sat on his hands as the Greenwich Police Department refused to insure a proper investigation of Mr. Bertino's police misconduct claim.


Just as Town Attorney John Wayne Fox and Greenwich Police Commissioner Peter Tesei has sat on their hands and refused to insure a proper investigation of my police misconduct claim.


The Town Of Greenwich gets burned in lawsuit after lawsuit, because Town Attorney John Wayne Fox Fiddles Away Like Nero.


I don't want to have to file a massive lawsuit against the Town Of Greenwich and the Greenwich Police Department, but I am left with no option. Town Attorney John Wayne Fox and the weak and ineffectual Police Commissioner Peter Tesei refuse to step up to the plate and insure that a fair, open and honest police misconduct investigation is performed.


Mr. Bertino has suffered permanent physical injuries including a torn rotator cuff, nerve damage and severe emotional distress from nervousness, anxiety and humiliation just because he asked about the arrest of his son.


THIS COULD HAPPEN TO YOUR FAMILY


You could be living in Old Greenwich and a policemen could wrongfully arrested your son after an officers unprovoked attack.

Your son could be outside of the Greenwich Diner trying to ask police about the arrest of a friend when the police asked him to wait to be spoken to. As your son moves back another officer grabs his wrist and attacks him, Screaming that your son was resisting arrest.

When you go to file a police misconduct complaint on behalf of your injured son who now has a police record and court date. However, the town and police fail to investigate the complaint filed against the officer who hurt your son.


Your son now suffers from sever emotional distress from nervousness, anxiety and humiliation.


THIS COULD HAPPEN TO YOUR FAMILY


Or maybe, you live deep in the back country of Greenwich and your daughter put up a picture of a Greenwich Police officer sound asleep snoozing away in his police car. She and her friends think the picture is so funny.


As she is driving home on the back roads of Greenwich four police cars pull her over. They start to illegally search your car. The look under the seats, in the glove box and in the trunk. She is terrified and quietly calls you on the phone.


You have to call 911 three times to get a police supervisor down on that dark and lonely road to stop the violations of her rights.


The police were going to write her a ticket to cover up the illegal search, but the supervisor tells the officer to withdraw the ticket.


When you go to file a police misconduct complaint some illegally appointed police captain refuses to investigate the violation of your daughters rights. It's her own damn fault for putting that funny picture of a police officer up on myspace.


One of your daughter friends is outraged at how she and her family is treated. Your daughters friend calls up the Greenwich Time to tell them about the myspace picture and the illegal search that it caused.


The Greenwich Time reporter calls you up in your back country home, and you tell the reporter about the outrage that has occurred to your family.


The police read the report and seek to discredit and humiliate your family for criticising them.


The School Police Officer is checking out her school records, the police talk to your employer and the Tax Assessor needs to inspect and reval your home.


This could happen to you because Greenwich does not have an independent civilian complaint board. The Greenwich Police Department is not held accountable to the citizens of Greenwich.


Without checks and balances keeping the police department honest then your son or your neighbors daughter and everyone else is in danger of deliberate indifference that can affect the safety and rights of you and you neighbors.


The Greenwich Police Department is made up of people. You don't give people absolute power, because absolute power corrupts.


A Civilian Complaint Review Board will protect you and your family from a police department that routinely fails to investigate citizen complaints.

01/05/08 - Plese Pray For My Wife. She Is Very Sick.

My dear sweet wife has became very ill since the backrooms and other non-public areas of her store were searched a week ago, because I spoke out about the lack of police services in Byram.

My wife is a sweet delicate and private woman who has been made very nervous from the illegal police search and the Police Department's
reaction to my civilian complaint.

My wife is very genital and artistic she was from South Korea. She was born the year the war started and came to the United States 30 some years ago.

When she left Korea it was a police state ruled my a military Junta. There was a curfew at night and she had many artistic friends who spoke out against the government and were arrested for very long periods without ever seeing a judge. However, due to often times violent student and union uprisings things have greatly changed in South Korea. There is now an elected President and the citizens have more rights.

Some of my wives past memories of police abuses have allowed her to become very anxious and fearful since her store was illegally searched. Even though the Police did not take her name or ask for identification as she cowered in the corner of her store, she none the less has been traumatized by the experience.

She does not want to open her store unless I am there with her, because she has became very fearful that the police will return. She has gotten a prescription for something called Adavan.

Unfortunately, her blood pressure shot up to 219 over 144 and she had to go to the hospital out of hear that she might suffer a stroke. However, she now has new blood pressure medications and the blood pressure is now in the 140 to 160 range for the top number and the bottom number is near normal.

Because of her fears she was not eating too well and became a bit weak and caught a cold that turned into ammonia and whopping cough. The doctors in the Greenwich Hospital emergency room x rayed her chest and prescribed some very strong anti-biotics as well as, some cough syrup with codeine.

The Adavan already made her sleepy and the syrup with codeine made her even more sleepy.

Many of her customers and members of her Church (Harvest Time On King Street) have came by to see her and told her that they will be praying for her speedy recovery.

She has been sleeping a lot and is getting better.

However, even though I am not a very religious man, but right now I would like to ask you to please include my wife in your prayers.
My dear wife means all the world to me.

Police Commissioner Peter Tesei, Chief Of Police David Ridberg and illegally appointed Police Captain Michael Pacewicz's illegal use use of selective enforcement tactics are going to expose themselves and the Town Of Greenwich to costly litigation and ultimately substantial court ordered judgments if they don't cease and desist in their coordinated and illegal activities.




I don't Know What Police Commissioner Peter Tesei, Police Chief David Ridberg and illegally appointed Police Captain Michael Pacewicz Were Taught About Free Speech In School.

I have fought censorship all of my adult life and I am more than prepared to use the United States Judicial system to defend my constatutionally protected right to critise the Greenwich Police Department.
First Selectman Peter Tesei can fail to lead and allow The Greenwich Police Department, the Assessors Office and the Clerks Office to selectivly and illegally prosecute me for exercising my constatutionally protected right to free speech, but in the end his fine record will be forever stained.
You can try and harm and ruin me for speaking out about the lack of Police Enforcement and Government sevices in Byram, but in the end there will be this terrible stain that will never wash off.
First Selectman Peter Tesei has hordes of petty buracrats and are very well armed Greenwich Police Department, but they are no match for me.
Because, I have a copy of the United States Constatution in my shirt pocket.

The most precious of all rights in this marvelous country called the United States of America is the freedom to think, write and say whatever is on your mind and last time I checked The Town Of Greenwich was still under the authority of the United States Constatution.
No one needs a First Amendment to write about how cute newborn babies are in the Greenwich Time, or to talk about a recipe for strawberry shortcake on WGCH.
Nobody needs a First Amendment for innocuous or popular points of view.
In America the majority must always protect the right of a minority-even a minority of one-to express the most outrageous and offensive ideas.
Only then is total freedom of expression guaranteed.

01/04/08 - The Police Commisioner Tesei Once Again Interfers With Legislative Branch Of Government


Enough With The Police Department's Dirty Tricks. Lets Just Go See The Judge.

When Police Commissioner Tesei, Police Chief David Ridberg and illegally appointed Police Captain Michael Pacewicz did not follow the laws of Connecticut. I was an up front and Civilized Gentleman. I went to the Connecticut Freedom Of Information Commission and requested a court hearing. Why can't Tesei, Ridberg and Pacewicz act like Civilized Gentlemen instead of thin skinned thugs?

For the second time in about 48 Hours Greenwich Police Commissioner Peter Tesei's Police Department Has Had A Lady Contact And Harass My Landlord.


Demanding That He Have Me Resign From My Town Of Greenwich Legislative Seat.


I got to listen to my landlord complain,


"I don't want trouble with these guys."


"You don't understand that I have a lot of property and they can make a lot of trouble for me."


"The police have more power than you in Greenwich"


"Can't you just go get a garage in Port Chester, so that they will leave me alone?"

01/04/08 - No Checks, No Balances - We Need An Experienced Police Commissioner That We Can Trust.


I have repeatedly told my Landlord to inform Mr. Tesei and his retaliatory Police Department that I received more signatures than any RTM Candidate in the Town Of Greenwich and I made some promises to district residents about how I am going to speak out about the problems facing Byram. Byram has been neglected far too long.



I have a month to month lease in a building that is zoned residential in district 4 Byram.


If Mr. Tesei thinks that I or RTM Moderator Thomas Byrne are going to let him dominate, interfere and manipulate the Greenwich Legislative branch of government, then he has another thing coming.


It is time that Peter Tesei's Administration stopped sneaking around threatening people.


If you want to challenge the residency of a Greenwich Legislator, then act like a civilized and dignified man and go see a judge. Then I can respond to your illegal and sneaky tactics to silence a voice for the poor and working class of Greenwich.


Mr. Tesei, needs to start waking up to the fact that he is the First Selectman and Police Commissioner is the Richest Town In The Richest State Of The Richest Country In The World.


We have the Best paid police department of any Town in Connecticut.


Yet people get mugged in Byram, while a police officer sits up on Putnam Avenue looking for burned out taillights.


Almost everyday the Town buys the First Selectman and his visitors a free lunch.


While some children in Byram miss a meal every now and then.


I have been a longtime resident of Greenwich and I am going to speak out so that some of the wealth of Greenwich gets sent down to Byram.


Even if Police Commissioner and First Selectman Peter Tesei succeeds in his attempt to drive me out of my home and make me homeless, he will not succeed in keeping me from taking the legislative seat I was lawfully elected to.


As I explained to Joan Caldwell, The Representative Town Meeting Pro Tempore, I am going to sit in the Byram District 4 seat I was lawfully elected to and I am going to advocate for all of the residents and merchants of Byram.


First Selectman Peter Tesei was listening in when I spoke to Ms. Caldwell


And Ms. Caldwell said I did not have any problems if I was a resident of the Town Of Greenwich and has slept in District 4 the night before the election.


I assured her that I had and that I had even been sworn in by the Town as an election Official the day of the election.


More over I told her I had slept more than 1,000 consecutive nights in Byram District 4, unlike the Gentleman that owns and lives in a house on Clapridge Road, but is elected to District 2.


It appears that this Republican gentleman rented a motel room at the Delmar Hotel the night before the election so that he could serve on a RTM district that he does not technically reside in. He sort of visits there occasionally.


It's OK with First Selectman Peter Tesei that this Rich Republican insider manipulates the Greenwich legislature, so that he can advocate for all himself and his rich buddies in downtown Greenwich.


But Mr. Tesei has a problem when a Poor Independent who actually resides in his district wants to advocate for the downtrodden of gritty.


The poor, the seniors, the single family homeowners, the youth and everyone else.


Byram will have adequate police protection and it's fair share of Town Services when I am done.


What the hell has Byram District 4 Chairman Robert McKnight and his cronies ever done to improve Byram.


Byram has steadily went down hill under the leadership of Chairman Robert McKnight.


Things are going to change, the people of Byram are going to be heard and responded to, by the big shots at Greenwich Town Hall.


And Mr. Tessi, don't be like Mr. Lash.


Don't use tax dollars to stuff your face and the faces of your friends with free meals delivered to Town Hall.


Taxpayers can't afford to feed wealthy bigshots, while the less fortunate go hungry.


Give the money to one of the Church pastors in Byram that are always being approached by working families and Seniors in Byram that could use a little extra food to make it through the month.

01/04/08 - Greenwich Police Officers Sit On The Post Road Looking For Burned Out Tailights In Hopes Of Making A Drug Arrest

The Byram Police Officer's Sit On The Post Road Looking For Burned Out Tail Lights In Hopes Of Finding Drugs In Cars That They Pull Over.

Yet When Someone Dies Of Drugs In Byram, The Police Do Not Go After The Drug Suppliers.


For example....

The John Bria "Drug Murder" Case In Byram.


John J. Bria was a 19 year old boy who had a membership in a fitness club and some say even worked out with a personal trainer.

John's friends described him as very health conscious.

This Byram boy earned an associate's degree.

He sent out resumes while working for his father's landscaping business. He even had an internship at a recording studio.

This was a 19 year old Byram boy that was looking to have a wonderful future and many say his family was very proud of him.

John was not known to be a hard drug abuser.

But in January of 2004, lots of hard drugs
-- including Prozac, cocaine, marijuana and Clonezepam, an anti-seizure medication -- were brought to the Bria household.

After a night of drugs John's father found him dead in his room the next day.


It looked like John's room had been set up.

Credit cards were left conspicuously on a nightstand, on an armrest, on an amplifier. Several ashtrays were empty or wiped clean.

There was a small silver pipe on his pillow next to his head. There were no ashes on the pillow.

An autopsy revealed heroin and cocaine in Bria's body.

The medical examiner who conducted it resigned in disgrace after taking a bribe in another case. His findings have been challenged. Later tests found codeine in John's body.

Police found a sealed cellophane wrapper containing 19 Prozac pills and 6 Clonezepam in the Bria bedroom, along with eight glyceine bags containing drug residue.

In almost any town in America these facts could generate arrests on charges that would range from drug possession, drug sales and up to homicide.

Yet the Greenwich Police Department Just Closed The Case, no one was arrested for all of those hard drugs.

The Greenwich Police Know That
Katie Hanscom, Megan Caron, Jason Cunningham and Savannah Lamotte spent time with John the night of his death.

The Greenwich Police also know that Jason's Cunningham's mother, Donna Cunningham, picked up her son the morning after the murerous party.

The Greenwich Police have taken statements from these druggies who refused to call 911 and get John medical attention.

Could John have been saved?

It is very possible?

Should these irresponsible druggies who covered up a murder, be prosecuted for the death of John?

Most definitely.

Are the Greenwich Police intimidated because Megan Caron's father is a rich Hollywood big shot?

Probably.

Let's Face the facts.
This wouldn't be the first time Greenwich cops backed off from a celebrity.

The Proof is that the Greenwich Police Department refuses to reopen the Byram Drug Murder Case.

It is not so contavercial, sitting on the Post Road looking for poor folks and minorities who have burned out tail lights.

Heroin Murder's With Rich Daddy's Are Not Held Accountable In Greenwich, because the Greenwich Police Department is looking for burned out car tail lights on Putnam Avenue.

My wive has had to spend the night in Greenwich Hospital being stabilized, because her blood pressure has shot up to 219 over 144, even though she is on three blood pressure medications.

This illegal search and raid on her store by four police officers has made her very afraid and nervous.

My wive is a Korean resident Alien who has lived in America for 30 years. When she left Korea it was ruled by a Military Dictatorship that ruled a police state. There was a dawn to dusk curfew. Korean citizens could be arrested and held indefinitely without due process and a trial.

This politically motivated raid on her store to silence a critic who was going to speak out about the police department has came close to giving my dear wife a stroke.

God forbid, that If my wife is incapacitated because Police Commissioner Peter Tesei looks on and dose nothing about police misconduct, then he may see a big chunk of his personal assets going to care for my dear wife.

It is a disgrace that Police Commissioner Peter Tesei has allowed illegally appointed Police Captain Michael Pacewicz not to properly and fairly investigate the illegal search and police misconduct that occurred in my wives store.

Shame on Police Commisioner Peter Tesei for allowing illegally appointed Police Captain Michael Pacewicz to deny my family and I our constitutionally guaranteed rights to due process.

Our youngest son recently returned from a tour in Iraq, defending the American Constitution against Islamic fascists that would come and take away our rights and establish a religious system of law to replace the Bill Of Rights.

My son went out on missions everyday, survived three IED attacks, received 11accomedations defending the constitutional rights that are being denied to my family and others in the Town Of Greenwich.

Shame on illegally appointed Police Captain Michael Pacewicz and Police Commissioner Peter Tesei for ignoring the oath they took to protect and follow the Constitution of the United States Of America.

It is a civil rights crime to the police to keep a critic of government from excessing his or her right to free speech. It is a civil rights crime to deny any citizen their rights of due process, no matter what thier race, creed or color.

Do you feel like a big man now that you have stood by and done nothing as a poor woman who would not hurt a fly is hospitalized.
