Defendant in Kissel case hires new attorney
Motive still unknown as case delayed

Those wondering what police believe motivated the two men charged in the death of Greenwich resident Andrew Kissel will have to wait at least a few more weeks to find out.

Wednesday afternoon in Stamford Superior Court, Judge Richard Comerford kept the arrest and search warrants in the case sealed pending a hearing on May 20 to decide the matter. The delay in the decision was granted because Leonard Trujillo, who has been charged with Mr. Kissel’s murder, hired a new counsel. Public Defender Patrick Culligan and has been replaced by Mark Sherman.

Mr. Sherman, who was officially hired on Tuesday, said he needed the time to get up to speed on the case and submit a redacted version of the warrant to Judge Comerford in an effort to keep information he feels could damage his client’s right to a fair trial if released to the public.

By delaying the case until later in the month, it also delays the probable cause hearing for Mr. Trujillo, who has been charged with murder and conspiracy to commit murder. That hearing had been set for May 21 and a new date has not been set.

In court Mr. Trujillo had to formally waive his right to have that hearing within 60 days of his March 22 arrest. Mr. Sherman said he has not decided whether to ask for a new hearing.

Mr. Trujillo has not entered a plea. Mr. Sherman said if the judge found there is probable cause to proceed with the case he would plead not guilty and dismissed reports that his client is cooperating with authorities to provide testimony against his cousin Carlos.

Carlos Trujillo, who served as Mr. Kissel’s driver and personal assistant, has been charged with conspiracy to commit murder and has pleaded not guilty.

At the May 20 hearing, Judge Comerford is expected to consider all possible redactions to the warrant and then decide whether it should be released to the public. A new probable cause hearing date could also be set at that time.

Arrest warrants to remain sealed in Kissel case

STAMFORD - The two suspects arrested in connection with Andrew Kissel’s murder last month were in Stamford Superior Court Wednesday where it was determined their arrest warrants will remain sealed for the time being.

Kissel was found stabbed to death in his Greenwich mansion in April 2006. This past March, Greenwich police charged Kissel’s driver, 47-year-old Carlos Trujillo, with conspiracy to commit murder. His cousin, 21-year-old Leonard Trujillo, was also charged with murder and conspiracy to commit murder.

The warrants have been sealed ever since the arrests. Police have also been very tight-lipped about the case. Many thought the arrest warrants would be unsealed Wednesday, but in a surprise move, Leonard switched his legal representation from a public defender to a private attorney. The new attorney, Mark Sherman, then asked for three weeks to make edits to the arrest warrants.

Carlos’ attorney also asked that the warrants remained sealed until edits can be made. The judge agreed that to unseal the documents now might put the defendants’ rights to a fair trial in jeopardy.

The prosecutor also asked for the identities of six key witnesses to be kept secret.

Carlos has pleaded not guilty, while Leonard has yet to enter a plea. Sherman must file his proposed edits by May 20.

U.S. Rep. Christopher Shays will be facing another difficult reelection campaign this fall, according to a Washington-based political report.

Shays, R-4, tops the list of incumbent Republican congressman most at risk to be unseated in the November elections, according to The Cook Political Report...

....The Cook Political Report, a non-partisan political newsletter, based Shays' vulnerability on factors such as past election results, party registration in the district and current cash on hand totals for Shays and his challenger, Democrat Jim Himes.

Reiter agrees with the assessment that Shays could be in trouble this fall. Over the last 50 years, New England, which had a strong Republican base, has been become Democratic territory.

Reiter said that as the Republican party began to grow stronger in the south, and moved to the right on social issues, Republican appeal waned in the northeast. This shift has put moderate Republicans in bind, Reiter said....

...Reiter said the issues that are driving the upcoming election are the usual suspects: the war in Iraq, health care, education, the housing market and the economy, which he believes will be the most important issue in congressional races across the board.

Shays support for the Iraq war has cost him some support in the 4th district, Reiter said, noting that Shays had two close reelections in 2004 and 2006.

However, it is still hard to say definitively whether or not this is the year Shays is defeated.

"It's been a balancing act (for Shays) in a swing district," Reiter said. "Sooner or later, I believe a democrat is probably going to win that seat."

The arrest warrants pertaining to the murder of real estate developer Andrew Kissel could be unsealed sometime Wednesday.

Kissel was found stabbed to death in his Greenwich mansion in April 2006. This past March, Greenwich police charged Kissel’s driver, 47-year-old Carlos Trujillo, with conspiracy to commit murder. His cousin, 21-year-old Leonard Trujillo, was also charged with murder and conspiracy to commit murder.

The baseball glove drive is named in memory of Michael J. Biondi husband of Greenwich Boys & Girls Club board member Cindy Biondi and father of four boys. Michael was also an investment banker and a lifelong baseball fan who devoted his life to his family and the community.

Joining the Mets and the Boys and Girls Club of Greenwich are area organizations such as the Greenwich American Legion Baseball, Cal Ripken League and others, which are inviting area residents to bring new and used baseball gloves to the drop-off location. The Greenwich American Legion Baseball organization will also be conducting a baseball clinic for Club kids before the rally on Sunday, May 18....

Police Watch: The following reports were released April 30

APPEAR

Jason Lee Fournier, 27, of Oxford, Maine, was arrested April 29 and charged with first degree failure to appear. He was in a Florida correctional facility and waived extradition. Police officers traveled to Florida and transported him back to Greenwich. Fournier allegedly failed to respond in court to Nov. 27, 1998, charges of second degree sexual assault, risk of injury to a minor and violation of probation. Fournier was being held on a $50,000 cash bond and is due in court May 7.

ASSAULT


Richard Stafford, 47, of 9 Lake Drive, Riverside, Rodney Stafford, 45, of Somerset, Mass., and Robert Stafford, 48, of 102 Silo Circle were all arrested April 30 and charged with third degree assault, disorderly conduct and third degree criminal mischief. Police had been sent to Bull Dog Restaurant on the report of a fight. According to police reports, the three brothers had gone in and kept asking for more drinks throughout their time there, showing no willingness to leave. Witnesses described Richard as “antagonizing” employees the entire time they were there. The brothers then allegedly assaulted a restaurant employee when they left, causing that person to be taken to Greenwich Hospital for minor bruising. All three brothers were released on promises to appear in court on May 7.

David’s Treasure Tree, located in Stamford Hospital’s Pediatric Unit, recently received a $10,000 infusion from Club Chefs of Connecticut to help restock the year-round toy closet. This year marks Club Chef’s largest donation to the cause, having raised more than $31,000 since 2004.

David’s Treasure Tree is a toy closet named in memory of 15-year-old David Kanarek, a Greenwich resident who lost his battle with acute lymphomatic leukemia in 2000. Children staying in Stamford Hospital’s Pediatric Unit can select from the toy closet a developmentally appropriate toy or gift to keep. David’s parents Robin and Joseph Kanarek founded the cause as a unique way to honor their son’s memory.

David’s Treasure Tree helps children enjoy a momentary escape from the hospital experience,” Robin Kanarek said. “We know firsthand what that meant to David and are happy that other children and their families can experience that, too. Police look for fake beach card witnesses


Police are trying to bolster their criminal case against an alleged counterfeiter who gave friends fake beach cards, one that relies heavily on a single whistle-blower with ties to the suspect, Chief David Ridberg said yesterday....

..."The woman who dropped off the stuff, one can infer she has something to gain from the other person going down," Ridberg said. "So, therefore, we have to overcome the stigma that the suspect is being setup."...

A message seeking comment from Assistant State's Attorney Steve Weiss was left yesterday at his Stamford office.

First Selectman Peter Tesei said the alleged forgery of town documents should not be taken lightly.

"That's why I felt from the very beginning it should be handled by police," Tesei said. "Obviously, the objective is to present as strong a case as possible that will result in a conviction. There are some nuances about it that certainly make it more complex than it should be."....

...Greenwich Time received a binder with materials similar to those described by town officials. It contained photocopies of beach cards from the 2005 and 2006 seasons with the names of several individuals and their supposed addresses, which were all in Old Greenwich.

None of the individuals named were listed in telephone directories at the addresses printed on the cards, however. One of the individuals was listed as a Stamford resident.

Photocopies of beach parking stickers from the 2006 and 2004 seasons also were included, as well as several marina permits from 2006.

I tagged along with a gentleman named Rob Adams, who is essentially the sports department to a Greenwich High School baseball game last week and hung out next to the GHS Cardinals dugout. The game itself was a lop-sided event - Greenwich losing to Wilton 11-2, but it was interesting to be that close to the action, and it was definitely a brand new experience as I had not been to an amateur baseball game in what seems like forever...

Meriwether's Troubled Fund Offers Early Exit

Following months of steadily declining returns in his hedge fund, John Meriwether is offering some investors an early out.

Investors of the JMW Global Macro fund, the smaller of the two funds managed by Meriwether's JMW Partners, are being offered the chance to pull out their money as soon as tomorrow....

Ordinarily, the fund's investors would have to wait until the end of June to exit, but Meriwether is probably offering these select investors an early out, so that he can use their money for a new failed investment fund.

Meanwhile, the New York Post notes that investors of Meriwether's flagship fund - the $1 billion Relative Value Opportunity fund, which had losses of nearly 32 percent as of the end of March - are less fortunate.

...Those positions have to wait till the end of June to get any money back. Based on redemption requests already received for Relative Value, one-eighth of total assets - the maximum allowed - is scheduled to be yanked....

.... Meriwether's Long-Term Capital Management became a household name after losing $4 billion in 1998.

.... Stephen Czech claims that Jonathan Bauer, who runs the roughly $4 billion Contrarian Capital Management in Greenwich, Conn., is withholding Czech's regular base pay and bonus "arbitrarily," according to a lawsuit filed in state court in Stamford.

The teeth of the complaint centers on an approved personal leave of absence that Czech had taken from Jan. 6 to Feb. 16 to seek medical attention for his 11-year-old son, who had been diagnosed with an inoperable brain tumor.

Czech alleges that during his leave his already shaky relationship with Bauer became contentious as Bauer became increasingly unreasonable about paying more than $1 million in total compensation owed to him.

Czech was racing to gather funds for pre- and post-operative medical attention to save his son's life and treat a plum-size tumor at the base of his brain stem.

Calls and an e-mail to Bauer requesting comment were not returned....

...Bauer's main argument for withholding his former portfolio manager's compensation was that a portion of it (about 25 percent after taxes) needed to be reinvested into the roughly $220 million investment vehicle or a yet-to-be-formed fund.

Communicating mostly via e-mail and BlackBerry, Czech had made attempts to settle the matter amicably over the past two months, but excerpts of e-mails filed along with the lawsuit depict Bauer as freezing up his employee's access to much-needed capital.

"Sorry for the confusion. Never meant to suggest that we had any intention of waiving the 25 percent requirement," read one e-mail Bauer sent to Czech on Feb. 16.

Bauer has since disbanded the fund Czech ran and has not launched a new lending fund, the lawsuit notes....
