A legal opinion by Attorney General Richard Blumenthal supporting the state's racial balance statute has many Greenwich educators confident that their plans to racially balance local schools are valid.

In an opinion dated Thursday, Blumenthal said that a board can still use "race conscious measures" such as active recruitment and adjusting attendance zones, to racially balance schools, but cannot use race itself.

he issue was called into question last year after the U.S. Supreme Court ordered schools in Seattle and Louisville to stop assigning students based on race, saying that was a violation of equal protection guarantees.

The Supreme Court case and Blumenthal's decision are important in Greenwich because the Greenwich board was ordered by the state to racially balance New Lebanon School. The statute orders districts to ensure each school's racial make-up is not greater than 25 percent of the town's overall racial make-up.

Superintendent of Schools Betty Sternberg last year recommended the board try to racially balance New Lebanon School even while the Supreme Court case cast doubt, in the eyes of some, that racially balancing schools would now be considered unconstitutional because of the court's decision. Greenwich and the state Board of Education requested the opinion from Blumenthal.....
