07/04/08 Have A Happy And Safe 4th Of July


When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. - That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, - That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.-Such has been the patient sufferance of these Colonies; and such is now the necessity which constrains them to alter their former Systems of Government. The history of the present King of Great Britain is a history of repeated injuries and usurpations, all having in direct object the establishment of an absolute Tyranny over these States. To prove this, let Facts be submitted to a candid world.

He has refused his Assent to Laws, the most wholesome and necessary for the public good.

He has forbidden his Governors to pass Laws of immediate and pressing importance, unless suspended in their operation till his Assent should be obtained; and when so suspended, he has utterly neglected to attend to them.

He has refused to pass other Laws for the accommodation of large districts of people, unless those people would relinquish the right of Representation in the Legislature, a right inestimable to them and formidable to tyrants only.

He has called together legislative bodies at places unusual, uncomfortable, and distant from the depository of their public Records, for the sole purpose of fatiguing them into compliance with his measures.

He has dissolved Representative Houses repeatedly, for opposing with manly firmness his invasions on the rights of the people.

He has refused for a long time, after such dissolutions, to cause others to be elected; whereby the Legislative powers, incapable of Annihilation, have returned to the People at large for their exercise; the State remaining in the mean time exposed to all the dangers of invasion from without, and convulsions within.

He has endeavoured to prevent the population of these States; for that purpose obstructing the Laws for Naturalization of Foreigners; refusing to pass others to encourage their migrations hither, and raising the conditions of new Appropriations of Lands.

He has obstructed the Administration of Justice, by refusing his Assent to Laws for establishing Judiciary powers.

He has made Judges dependent on his Will alone, for the tenure of their offices, and the amount and payment of their salaries.

He has erected a multitude of New Offices, and sent hither swarms of Officers to harrass our people, and eat out their substance.

He has kept among us, in times of peace, Standing Armies without the Consent of our legislatures.

He has affected to render the Military independent of and superior to the Civil power.

He has combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws; giving his Assent to their Acts of pretended Legislation:

For Quartering large bodies of armed troops among us:

For protecting them, by a mock Trial, from punishment for any Murders which they should commit on the Inhabitants of these States:

For cutting off our Trade with all parts of the world:

For imposing Taxes on us without our Consent:

For depriving us in many cases, of the benefits of Trial by Jury:

For transporting us beyond Seas to be tried for pretended offences

For abolishing the free System of English Laws in a neighbouring Province, establishing therein an Arbitrary government, and enlarging its Boundaries so as to render it at once an example and fit instrument for introducing the same absolute rule into these Colonies:

For taking away our Charters, abolishing our most valuable Laws, and altering fundamentally the Forms of our Governments:

For suspending our own Legislatures, and declaring themselves invested with power to legislate for us in all cases whatsoever.

He has abdicated Government here, by declaring us out of his Protection and waging War against us.

He has plundered our seas, ravaged our Coasts, burnt our towns, and destroyed the lives of our people.

He is at this time transporting large Armies of foreign Mercenaries to compleat the works of death, desolation and tyranny, already begun with circumstances of Cruelty & perfidy scarcely paralleled in the most barbarous ages, and totally unworthy the Head of a civilized nation.

He has constrained our fellow Citizens taken Captive on the high Seas to bear Arms against their Country, to become the executioners of their friends and Brethren, or to fall themselves by their Hands.

He has excited domestic insurrections amongst us, and has endeavoured to bring on the inhabitants of our frontiers, the merciless Indian Savages, whose known rule of warfare, is an undistinguished destruction of all ages, sexes and conditions.

In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.

Nor have We been wanting in attentions to our Brittish brethren. We have warned them from time to time of attempts by their legislature to extend an unwarrantable jurisdiction over us. We have reminded them of the circumstances of our emigration and settlement here. We have appealed to their native justice and magnanimity, and we have conjured them by the ties of our common kindred to disavow these usurpations, which, would inevitably interrupt our connections and correspondence. They too have been deaf to the voice of justice and of consanguinity. We must, therefore, acquiesce in the necessity, which denounces our Separation, and hold them, as we hold the rest of mankind, Enemies in War, in Peace Friends.

We, therefore, the Representatives of the united States of America, in General Congress, Assembled, appealing to the Supreme Judge of the world for the rectitude of our intentions, do, in the Name, and by Authority of the good People of these Colonies, solemnly publish and declare, That these United Colonies are, and of Right ought to be Free and Independent States; that they are Absolved from all Allegiance to the British Crown, and that all political connection between them and the State of Great Britain, is and ought to be totally dissolved; and that as Free and Independent States, they have full Power to levy War, conclude Peace, contract Alliances, establish Commerce, and to do all other Acts and Things which Independent States may of right do. And for the support of this Declaration, with a firm reliance on the protection of divine Providence, we mutually pledge to each other our Lives, our Fortunes and our sacred Honor.

Fireballs Explode Over Havemeyer Field

Two 10-story-high churning fireballs gave 5,000 Greenwich spectators the fright of their lives Saturday during the 17th annual Salute to Veterans at Havemeyer field behind Town Hall.

Young Girl Dies of Overdose

A Western Middle School eighth grader died of a drug overdose in the early morning hours of June 26.

Daisy Pacheco, 14, was taken by her Hamilton Avenue family to the Greenwich Hospital Emergency Room on June 25 at 10 p.m. She was then transferred to the Westchester Medical Center for advanced care where she was pronounced dead the following morning at 5:52 a.m.

An autopsy was performed by the Westchester Medical Examiner's Office on June 27. Preliminary medical results show she died of an overdose of over-the-counter medications, said Lt. Richard Cochran of the Greenwich Police. Further toxicology results will be forthcoming the end of the week.

Pacheco was described as "a good student" who fully participating in school activities, said Stacey Gross, principal of Western Middle School. "She entered as a second language student and, as an eighth grader, she was mainstreamed into all classes. She competed in the Colt Foreign Language Poetry Contest for three years," said Gross.

Pacheco also played a role in helping an initiative to increase participation among classmates in extracurricular activities. "She would have made a nice addition to Greenwich High School," said Gross.

At the wake held Monday at the Leo P. Gallagher & Son Funeral Home in Greenwich, Gross reported a "large turnout" of students, parents and faculty who "showed their support and how much we will miss her."

Woman Arrested Following Altercation

Monica R. Lane, 38, of Stamford, was arrested on June 17 at 9:33 p.m. for risk of injury to a minor and for disorderly conduct.

Police were detailed to 11 Kirby St. on the report of a female entering a house and punching another female. The victim reported Lane had exited her vehicle, yelling at her while holding her young daughter, then followed them into her house, yelling for her husband.

Lane was told to leave the house, refused and then grabbed the victim, pulling her backward, causing the daughter to hit her head on the door jam.

Lane was released on a $1,000 cash bond and assigned to appear in Stamford Superior Court on June 25.

Two Teens Arrested After Stealing Truck

Two teenagers attempting to outrace police in a stolen Ford pickup truck in the early morning of June 24 were caught and arrested in Byram.

Kelsey Curley, 18, of 296 Delavan Ave., and Oscar J. Maciel, 19, of Port Chester, N.Y., were charged with larceny in the second degree, conspiracy to commit larceny, interfering with an officer, possession of burglary tools and criminal attempt at larceny in the second degree.

Police responded at 4:57 a.m. to a report of a theft of the Ford truck from a Pemberwick Road home. The truck, with Curley at the wheel, was then spotted by police at the intersection of Byram Road and West Putnam Avenue. Police activated overhead lights and siren and gave chase. Curley disregarding two stop signs before bringing the truck to a stop in a private drive at 216 Byram Road. Both young men attempted to escape on foot, but were apprehended by police.

Curely was unable to post a cash bond of $10,000 and was told to appear in Stamford Superior Court on July 2. Maciel was released on a $10,000 cash bond and also assigned to appear in Stamford Superior Court on July 2.

Teen Arrested for Sexual Assault

David Moss, 18, of 4 Grange St., was arrested on June 29 at 4:30 p.m. on charges of sexual assault in the second degree and risk of injury to a minor.

The charges stem from a report that Moss had sexual intercourse with a 15-year-old girl. He was released on a $1,000 cash bond and assigned to appear in Stamford Superior Court on July 7.

Three Arrested in Love Triangle

A love triangle dispute accelerated into physical injury and a crashed automobile.

On June 29, police were detailed to 35 Ritch Ave. on a report of a possible fight threat. Gisell A. Martinez, 22, and her sister, Maria Martinez, 26, both of Bridgeport, and the latter's boyfriend, Edward Ramirez, 25 of Stratford, were involved in a verbal dispute that started in a motor vehicle and continued onto Byram Shore Road.

Maria Martinez stuck her head causing a minor laceration while exiting the vehicle. Gisell Martinez then reentered the car with Ramirez and exited the scene traveling south on Byran Shore Road whereupon she crashed the car.

Gisell Martinez was charged with breach of peace, unsafe movement, operating an unregistered motor vehicle, with additional charges of operating without insurance and operating a vehicle with a suspended status. She was released and appeared in Stamford Superior Court on June 30.

Maria Martinez was charged with breach of peace and released into the care of Greenwich Hospital for her injuries. Ramirez also was charged with breach of peace and he and Martinez were assigned to appear in Stamford Superior Court on June 30.

New York Man Hit with Multiple Charges

Christian Romero, 21, of West Hurley, N.Y., was arrested on June 29 at 1:25 p.m. for use of a motor vehicle without permission.

Police were called by a woman at 4:23 a.m. to relate her friend had taken her car earlier that morning without permission, had returned it with extensive damage and was nowhere to be found.

By happenstance, police had while checking out the reported scene of an accident in the area of the Merritt Parkway at Round Hill Road found damage to the metal guardrail on the western shoulder of Round Hill Road on the Merritt overpass. A Connecticut license plate was found beneath the guardrail matching the woman's missing vehicle.

Police subsequently received a call from the woman at 12:45 p.m. that she had been contacted by Romero, that he was at a friend's house sand would await the arrival of police.

Romero was also charged with evading responsibility, unsafe movement, operating a motor vehicle without a license and criminal trover (taking what was not his and damaging it) in the second degree. He was released on a $1,000 cash bond and appeared in Stamford Superior Court on July 2.

Road Arrests

June 24: Nery Alexander Lopez, 25, of Stamford, was arrested at 2:36 a.m. for driving while intoxicated, failure to drive in an established lane and operating without a license.

Lopez's car was observed crossing the double yellow lines on East Putnam Avenue. As it approached River Road, the car was partially traveling in the southernmost westbound travel lane.

Police stopped Lopez and found him displaying signs of being under the influence of alcohol, having a strong odor of alcoholic on his breath and person. Lopez admitted to having had two drinks. He failed field sobriety tests but refused to submit to chemical analysis.

He was assigned to appear in Stamford Superior Court on July 8.

June 24: Deborah H. Nixon, 58, of Stamford, was arrested at 4:23 p.m. for possession of marijuana and drug paraphernalia.

Nixon was observed entering the intersection of Railroad Avenue and Arch Street against the red traffic control signal. Police made a stop of Nixon's car and detected a strong smell of burnt marijuana. Nixon admitted to have marijuana in her person and a "joint" in her ashtray.

A large bag of leafy green substance was found in her bag that she said was marijuana. Drug paraphernalia was found in a pouch on the passenger seat as well as the marijuana cigarette in the ashtray. The leafy substance tested positive as marijuana.

The amount weighed 7.6 grams and the "joint" of 0.4 grams.

Nixon was assigned to appear in Stamford Superior Court on July 8.

June 29: Nicholas Frank Wyman, 24, of Armonk, N.Y., was arrested at 10:30 p.m. for possession of four ounces of marijuana.

Police were detailed to 275 Round Hill Road for a single vehicle collision in which the sole occupant and operator of the vehicle was Wyman.

Wyman sustained injuries in the collision and was transported to Greenwich Hospital where he was treated for his injuries.

While conducting a motor vehicle inventory, officers discovered a clear pill bottle containing a green, leafy substance that was suspected to be marijuana on the driver's floorboard. The substance tested positive for marijuana.

He was released on a $250 cash bond and assigned to appear in Stamford Superior Court on July 7.

Juvenile Arrest

June 27: An underage female was arrested at 2:41 p.m. for both criminal attempt of forgery and forgery in the third degree.

The assistant branch manager of Greenwich Bank & Trust reported a white female, who was attempting to pass a fraudulent check, was waiting in the bank's lobby. The manager had contacted the account holder and learned the check in the amount of $7,700 was forged and not authorized.

The female, when confronted with the check, related she found the check somewhere in Bridgeport and forged the information on the check.

She was held in lieu of a $5,000 cash bond and was scheduled to appear in Juvenile Court on July 2.

Red Cross offers fireworks safety tips for holiday

With the Fourth of July today, the Greenwich Chapter of the American Red Cross is offering fireworks safety tips.

The following are released arrests from July 3.

LARCENY

A 15-year-old Greenwich boy was charged June 11 with conspiracy to commit fifth degree larceny. The boy was allegedly involved in stealing an iPod Touch from a student’s bag in Greenwich High School’s student center. He was referred to the juvenile court for further action.

BURGLARY

Police arrested three 15-year-old Greenwich boys June 11 and charged them with seven counts of third degree burglary, eight counts of conspiracy to commit third degree burglary and third degree larceny. The three boys were charged on warrants in April after police investigation led officers to determine they were responsible for breaking into and stealing items from numerous vehicles in Glenville during April. The boys were referred to juvenile court.

DISORDERLY

Police arrested three 15-year-old Greenwich boys and charged them with disorderly conduct June 20. Police said the boys vandalized a person’s car and house on June 17. The victim told police the boys set off fireworks in his yard and shined a laser pointer into his house. Investigators determined the boys were responsible. One of the three was also charged with two counts of third degree criminal mischief and two counts of second degree criminal trespass. A second was also charged with one count of second degree trespass. They were referred to juvenile court.

MISCHIEF

Two 15-year-old Greenwich boys were charged June 20 with third degree criminal mischief and disorderly conduct. Police said the boys vandalized a house by throwing rocks at it and breaking a window. They were referred to the juvenile court.
